if you are laying copper underground then it should be well lagged and about 12" deep preferrebly in accessible duct. You should also fit a pipe thermostat to protect from freezing.
Pipework inside should have a minimum of 1" cover after lagging

How high is the vent over the top of the F/E Tank ie the waterlevel in the vent pipe is the same as of that in the tank. Is the vent simply hooked over the top of the tank?
