    PD rights in Planning Permission

mixed use development will be a big plus point on your application i think as the NPPF and local plans like to site people as close to work as possible.

    PD rights in Planning Permission

£3000. Who told you that? your agent perhaps? pre application advice in my local authority is £200. Look on your local council website. I can;t believe that it will be £3000. In a lot of ways a pre-app is better than early / initial agent advice because the advice comes straight from the...

Disputing a Planning Enforcement Officers Decision

An application from 20 years ago would have expired. Currently 3 years is the period from decision date to build date. AFter that time then technically you have to reapply.

Disputing a Planning Enforcement Officers Decision

But they could decide that it is a minor breach of planning and just argue that it's not expedient to act. It's a similar thing in effect.

Have discovered multiple breaches from adjacent development - Do I have any hope?

Do you mean.. how was it signed off as a dwelling by building control? Building control don;t check the planning permission they just check that the property is safe. Plus planners don;t really go and look at the building after it is built. They pretty much rely on the public to report...

Overcome original planning permission condition forbidding extensions

A pre-app is just an indication of the council's view on a particular proposal. It doesn't cement anything in stone. If they indicate support for a certain idea it doesn;t mean that you can't submit a full planning application for something different, or even do a another pre-app first. At...

Overcome original planning permission condition forbidding extensions

Of course you can apply to remove a planning condition. :-) Apply to vary or remove conditions Sometimes circumstances change so that a condition imposed at the time permission was granted is no longer necessary. An application can be made to vary the terms of a condition attached to a planning...

    Bike storage in front garden

GPDO 2015 states - No outbuilding on land forward of a wall forming the principal elevation. So I would have a word with your neighbour. Make sure they are ok with it first. Howvere, even if they reported to planning enforcement, it is likely they will say that it is "not expedient" to...

Have discovered multiple breaches from adjacent development - Do I have any hope?

I think the physical building of it itself comes under the four year rule. So it was over four years ago so now they have no duty to enforce that. I believe the ten year rule covers changes of use, not the actual building of the property. It was given permission as a residential dwelling...

Overcome original planning permission condition forbidding extensions

Apply for a Removal of Conditions? Or do a pre-app first to test the water at the Council? You don't need proper drawings for a pre-app, just a location plan and your rough ideas. If your ultimate aim is to build under PD then you don;t need architects drawings to submit to the council for that.

    What Constitutes Commencement of Works?

Technically the perrmission is lost after 3 years but the council don't go around monitoring that sort of thing as such. If you have a neighbour who has a bee in their bonnet then they may complain to planning enforcement, who may then insist that you reapply. If you did have to reapply, but...

Economical (cheap!) drawings for garage to apply for Lawful Development Certificate

If it is PD, perhaps you could maybe prove the date it was built and them print out the pertinent PD regs for the time it was built. I dont know how solicitors view that though?
