please help, roof a total disaster

Hi everyone

I had a new dining room extension done in summer. It was designed by architect at a pitch of 12.5, and specified using Marley Mendip tiles and special velux for low pitch roof.
The roof was designed at 12.5 degrees because the kitchen had already been extended out to 4.3m when I bought the house, and to create the dining room knock through, the only options were low pitch or flat roof.

I had many issues with the builder, including waiting until the old ( hipped) roof was removed to order the Marley Mendips. Unsurprisingly , he couldn't source them at such short notice and purchased some alternatives that he assured me were suitable for the pitch.

The work finished in August and was leaking above the kitchen window, bifold doors, and apex by mid October. It failed building control inspection in the same week because of the leaks , and many other issues including inadequate flashing and exposed OSB and felt at the eaves. Builder iniitaly refused to accept findings but came back and added some silicone to lead flashing.
This did not work and the leaks got worse. Building control failed it again in December and added to the report that the tiles were wrong and the velux not per specification on drawings.
The builder argued with the architect , the building inspector and myself that we were wrong, and insisted that all it needed was a new fascia and some more lead work. He repeatedly failed to show up for when he said he would. By January when he still had not accepted the findings on the report , I told him that I would be getting someone else to do the repairs. He blocked me after this. I asked for his indemnity insurance but he said that it was my fault I didnt let him finish the job so insurance not relevant in this case and he has let his insurance lapse anyway. All he has is public liability - so I'm screwed really in terms of getting any recourse from him.

My issue now is how to proceed. I know that I need to sue him and thats a sort of side issue really to the leaking roof and upset I feel about it all. I have had an independent report carried out by a local building firm a few weeks ago who identified all sorts of issues outside of the roof, including brickwork that is not plum, wrong brick used at the DPC - all sorts. I also had 2 roofers out to look at it and none of them could find a single part of the roof that achieved the required 12.5 degrees. At best it is 12 at the velux area, and a shocking 5.1 at the eaves.

The first roofer said it needs stripped, completely rebuild and he would use 3 inch firrings to create an adequate fall. The second said he would use 'fillets' ( which I'm assuming is the same thing. The builder who did the report never mentioned raising the pitch, only that the correct tiles need to be used, but also correct size facia, new leadwork, and proper velux.

Please tell me - what would you do in this case? how would you fix the pitch? I'm sorry its been so long and if i havent explained it all properly. I feel so let down by it all and that the builders took total advantage. Aside from things like drinking on site, the way they spoke to me as a woman should have had me running for the hills from day one. I regret eve going near them and will now likely have to find thousands to correct what he has done.

by the way the drawings do not call for 'firrings# or wood fillets, but the roofer explained this as just finding a way to work with with what Ive got
 
Take the covering off and then fit furrings and new deck on top of the existing. If this is not possible for whatever reason, strip it back to the joists and replace. Don't forget any ventilation and insulation.

If you are going to sue, then you would normally need a report from an independent specialist - such as a building surveyor. You can't rely on the opinion of another builder or roofer in court.
Also get written detailed quotes of the remedial works. You should mitigate your losses so will need to prove that your costs were justified and reasonable

I'm hoping the legal aid people through my insurance would send a surveyor? I can't afford another report. :(
The worry I have is that the suggested repairs so far from 2 roofers don't sound anything like the original drawings. But then I suppose it isn't going to since the roof is now already constructed , however badly

I wouldn't know if he has assets. I know he has lots of expensive tools and a van , but lives in LA housing. That's all I know.
Do you not think it's worth it? :(
I'll have to go into debt again for the repairs. One roofer quoted 4k and the other 1800

Normally you would tell builder/roofer what you want them to do, and not let them suggest what they want to do. That's why you've got stupidly different quotes.

You have a drawing don't you? That's what needs to be done.

Otherwise, get someone to prepare a schedule of work, and get prices for carrying that out. That way, you get comparable quotes.

Not necessarily. Once a court order is obtained, there are options to then wait or enforce it.

Even if this bloke is in council housing, there is typically a tenancy clause to prevent tenants operating a business from home. So a court order can lead to him losing his home. And other landlords may not want tenants with CCJs or bankrupts.

First roofer at 4k quotes works as follows :

Upon visiting the property at xxxx and assessing recently completed roof works to a rear extension of property it is clear standard of works is clearly below good workmanship and doesn't meet roofing regulations, nor is an acceptable standard of works completed to extension roof faulty works pitch of roof roof tiles use are not adequate gauging out of tiles is unacceptable installation of lead works installation of velux windows dry verge system are faulty and ridge tiles and pointing is not nice to the eye or finished to a exceptable standard of workmanship. So in my view and over 25 years experience it is clear all works need to be remedied and re done to a higher standard of works to rectify and make good.

Erect a small portable aluminium scaffolding tower for access to works also placing a skip on site for the removal of debris. Remove all existing roof materials lead works dry verge system roof tiles ridge tiles batons felts and velux window flashing kits install 3 inch firings to roof rafters giving a more adequate fall to eaves install 1.5 meter x 300 cavity protection and felt support trays to all eaves lay a vapour free breathable felt membrane to all roof areas before gauging out 2x1 water treated roof batons to accommodate roof tiles (Marley Mendip or a Double Roman adequate for pitch) adjust velez windows to accommodate new pitch of roof before laying roof tiles cutting in around velux windows to a neat finish while re installing flashing kits sealing velux to main roof elevation grind out brickworks/mortar joints to a depth of 20mm 2 course of brick up from roof level ready for lead work installation. Screw fix in place 4 meter x 2x1 inch roof batons to gable sides before installing a black breathable upvc dry verge system with a decorative ridge cap install new Code4 300mm leadworks acrooss rear of extension inserting in to previously ground out brickwork and under window cills repointing to a neat finish using a standard 3/1 mortar mix insert 2x1 timbers to ridge tree before installing a breathable dry ridge system kit with ridge tiles to match colour and profile of roof tiles before re plastered inside window reveals of velux windows to complete works. Remove all debris from site leaving clean and tidy all works to be completed to a high standard and to customers satisfaction completed works will also carry a full 5 year Guarantee upon completion and receiving all payments in full

Sub Total £4,087 Inc VAT
 
Second roofer quoted as follows:

"Ok I’ve spoke to my joiners and there are saying the same as me so I’m thinking the only way to move forward with this is for us to strip the tiles off the battens and felt.
So we can get back to the timber roof structure
Then once we have got back to the timber roof we need to fit some timber fillets on top ov the timber spars
This will lift the structure up slightly and getting u to ur 12 degrees maybe abit more
The timber fillets are strips ov timber cut from 3inch down to nothing 4 meters long on ever timber spar
So lifting the back ov the roof up slightly
Then re tile the roof back for u
This is what I had in mind for it aswell
This work will come to £1500 plus vat £1800
Ile buy everything we need the felt the tilt fillets and anything else plus new lead at the wall that’s longer on the tiles. Thank you

When you win, you could maybe go for an 'attachment of earnings', to recover the money, or bankrupt him. Is it a formal company, Limited company?
 
I can't find him on any companies House or registered for tac anywhere. He insisted on cash from me. Every penny. I know , I know. .

He is absolutely all over social media though and with good reviews too , hence my choosing him. I think he does have it in him to be a decent builder , but he is not a roofer, clearly.

If he hasn't officially registered his company I am guessing there is little I can do. He refers to himself online as the 'premier building company' for our city. Jeez
