Yeah but how can she prove she wasn't one of the 40% that takes in her own MRSA? What about everyone else that gets it and loses body parts?
And why was she in hospital at all? Didn't hubby put her there?
 
I suppose the big difference here is that most ordinary folk havn't got the kind of money she has to risk taking the NHS to court.
 
The should have gone to court over it. Next time a patient loses a leg due to MRSA they'll expect a payout too. If they are poor and are eligible to claim legal aid will they be able to claim if they claim criminal negligence?

The only thing with Lesley Ash's case is it was settled out of court therefore they didnt set a precedence, any future claimants would still be taking a risk that they would win.

I must admit that I was surprised at the amount offered as i'm sure she would never have got anything like that from a court settlement, perhaps there are other liabilities that where unpublicised as part of the settlement?
 
It shouldn't be allowed for a body such as the NHS to make deals - it should be law that it MUST go to court so the people can see justice done (if a payout of say £250K plus is sought).
 
Agreed, it's our money they are playing with and should be accountable for it.

hospitalize with legionnaires disease because of bad maintence by the council, on a air vent, system , :shock: they got took to court 1million cost, £100.000 fine , £20.000 for each of the dead, £8.000 for the only nearly dieing. :? but they did not have a tv career and never will now :lol: we made be moron's but we should get the same as the lips :?

If you're implying that there should be a clear and fair and just and equitable scale of compensation so that all 'victims' know where they stand (or sit), then I agree with you.

I'm pretty sure that the NHS is accountable for its expenditure.

However, I don't subscribe to this view that NHS is spending "our money", in the same way that I don't think I pay part of the salary of the policeman who was last brusque with me. Once my taxes are paid, they're entrusted to a government agency to spend it efficiently and according to its remit, and left by yet another government agency to oversee that expenditure. Of course the NHS isn't 100% efficient and competent, but I can accept that as a fact of life. However, unlike most people who bleat and whine on this web site, if I believe that someone in public office is acting just a bit too incompetently, or criminally, then I present my views to my MP, because that's what he's there for. I don't see how someone can criticise the system and in the next breath admit to not being ars*d to do anything about it.

If that were true, then you'd find it very easy to predict that I've already Emailed my MP about this.

However, I suspect that I'm no more predictable than at any other time, and you've just become aware that I tend to react in the same way when circumstances repeat themselves. Responding unpredictably would be the result of an irrational and poorly thought out reply, would it not?

And Lesley Ash, and her husband, the NHS, all the lawyers/mediators involved, anyone at the bank with access to accounts, in fact hundreds of people will know, and that ain,t speculation.
