Boiler room....vent

My gas boiler is situated in a purpose built room with a flue going up a chimney(sleeve inserted) . There is a small window in this room which is permanently open. The opening catch is screwed down to prevent it from being closed.....does this comply with current legislation please..?
it has been like this since beinging built some 30 yrs ago !!
 
Without any relevant details; type and output of boiler etc ,how the hell would we know?
 
Careful, DIA - you don't know the size of the boiler room.

You don't need the size of the boiler room.

The ventilation is high and low level, and a window in the middle don't count, not even for the old regs.
