It was Northumbrian Water who told us it wasn't their responsibility not the man who jetted the drain. We need to find out if the plans should be updated in case it happens again.

Yes they came out this morning and told us it's not their responsibility, we've got someone coming out in the morning to jet the drain and if it blocks outside on the public highway the water company will have to sort it!!

Yes we have a legal easement over the land with rights of access nobody is stopping us from going onto the land but the water company say it's a private matter and we have to get our own drain jetter

Yes but the land it crosses is private not lateral because the grantor of the easement has a different drain. If we were connected to that drain it would be lateral.

Thanks for all your help. I think the problem is that the neighbour who granted the easement doesn't use our drain he has his own so it is private unfortunately.

They're saying that as the drain crosses a private garden that does not share it and that it is blocked on that garden it is not their (Northumbrian Water's) responsibility.

@MNW67 Thanks but no because the drain has an easement of approx 50 m over a garden that doesn't share it before it reaches the public highway and the blockage is on the 50 m stretch.

Thanks John, so how does the small tank fill with water?

The water won't have been turned off long enough to empty four gallons. The large cold water tank would also keep filling it as it does the cylinder tank (gravity fed)? Noise has stopped so that must have been the cause.

It's an f&e system with tank in loft so the water would run until the tank emptied whether the water was on or not.
