My parents had visits from both Transco and British Gas, but were never furnished with a report. Just a job number and paperwork confirming the disconnection. It was carried out as an emergency job.

The modified flue was originally fitted with the previous boiler - which was installed in approx. 2001.

The modification was carried out by the neighbour so we have no paperwork. We also have no access to the shed or the wall as it abuts their land. They have never claimed to have consulted my parents prior to or concerning the modification, it simply came up as part of their defence in the matter.

My parents had no hot water or heat and, as my mother had been very seriously ill earlier in the year and was quite weak, they felt they had no alternative but to install a replacement (located elsewhere) as soon as they could.

The boiler was disconnected because the flue was inside the neighbour's shed. Completely enclosed! The modification did not come to light until fairly recently.

A helpful neighbour would discuss modifications of someone else's property - with the owner of that property - before carrying out a potentially life-threatening modification, surely?

The wall meets the boundary but does not cross it. It is not a party wall as it encloses one dwelling and is not shared. The original boiler was installed in approx 2000//2001 and was disconnected in July 2006 after being declared unsafe by Transco and then by a British Gas Inspector who...

The dispute was partly about the shed and partly about occluding the flue. It was only when we saw photographs from a joint expert that we realised the flue had actually been modified. The dispute has been going on since July 2006 and I cannot get anyone to take the issue of the flue...

Well, that is rather my point... they modified an appliance and created a danger. The man from Transco was horrified! Photos are in an album somewhere in my profile.

Of course there are issues, but the flue belongs to my parents, not to the neighbour, who never complained or took issue with it at any time, prior to enclosing it in a shed thus deliberately creating a danger to my parents.

Thank you for your help! That is what I thought, but I cannot find any specific regulations or legislation that will support my argument. Could you let me know where to find this information so I can throw it at my parents' solicitors to stop them being so ineffectual?
