Is this a party wall or not?

Hi Wessex. I will respond when I am home and have a keyboard and perhaps more of my brainpower available.

Is this a party wall or not?

I am the BO. A flat (freehold) with a flat above. No issue between me and the flat. When I refer to above and below, I mean the image. The neighbours with the shorter property is the one who wants a PWA. He was going to accept the works and several days later said the neighbour on the bottom...

Is this a party wall or not?

I believe that is the case. The fees for the surveyor are quite high and I suspect it was unsolicited letter. To resolve the situation, I believe there are three options. 1: I agree the party wall boundary and get it drawn up as a civil matter 2: Get a chartered land surveyor to determine...

    Ivy, how bad is it?

Thank you all for the replies so far. I've ask my neighbour to send pictures of the roots and so far he hasn't. What are my rights for inspection? He seems adamant to get a gardener out to prune back the hedge, which I don't have a problem with per se. However, I understand that the roots of...

Is this a party wall or not?

Hi Woody. There are two neighbours who are using the same surveyor who is not mine, the adjoining surveyor. The PWA is being drawn up for the neighbour below me. I have no issue with that. Whilst the surveyor was doing a schedule of condition he visited the neighbours who I don’t think is...

    Ivy, how bad is it?

Evening all, I am increasingly concerned about the ivy growing up my wall from my neighbours garden. I am asking to see the roots of the ivy, as I think they may be interfering with the foundations. Has anyone had a similar experience? Assume the best way to treat it is to cut the roots, let...

Is this a party wall or not?

Hi Woody. The issue is the adjoining neighbour and his surveyor want it both ways. They are claiming that for the duration of the work, we should treat the wall as a party wall. If we don't treat the wall as a party wall. I pointed out if they wanted to do this, then the title plans/deeds...

Is this a party wall or not?

Reading the act, it is clear that the wall belongs to me. The only thing I can believe that could be claimed is if my wall building is over the boundary line.

Is this a party wall or not?

Where could I find legislation/literature around a party wall having a room either side?

Is this a party wall or not?

Thank you. That was aligned to my thoughts. I imagine I could proceed with the works stating that I don't believe the act applies because the wall is not a party. If the neighbour was to oppose, he would have to get the wall to be determined as a party wall.

Is this a party wall or not?

On the image above there is a wall running into the staircase, top left. That is where the end of their building ends. There is no structure on that part of the wall, it is just the garden.
