Backfilling round outside of foundation

Hi, I had an extension built earlier this year and round the outside of the foundation there is still a bit towards the top where the earth hasn't been fully backfilled. Can this be backfilled with soil provided I stay well below the dpc or does gravel need to be used for drainage? Thanks
 
It would be better with some sort of hard infil if you are going to put a path on it as opposed to turf up to the wall.
 
Thanks. Eventually there will be a patio going up to it but that will be for next year and in that case the full garden will be getting re levelled and groundwork done. This is more to get rid of the gap between the existing garden and the foundation/trench block stages
