Combi boiler horizontal flue distance from guttering

Hi, Just had a boiler safety check and he said the flue is too close to the gutter and he could fail the check but just added as a warning. It has been there for 17 years and no signs of heat damage. I will just put a stainless steel guard to protect the gutter but seems a bit OTT.

Absolute nonsense, and no need for a guard - the flue is a coaxial, balanced flue. Cool air is drawn in via the outer pipe, the warm exhaust exits via the inner pipe.

Fail it on what exactly? If anything it would be not to current standards - not a safety issue. That looks like a Vaillant flue, which as per mi's is 75mm away.
