Damp in boundary wall

I moved into a new build detached property in January. Our neighbour's garden is a meter or so higher than our garden and is separated by a brick retaining wall. I have noticed that the bottom of the wall is permanently damp even though there has been no rain for weeks now. The soil is clay.

If there had been rain then I could understand that there would be seepage from the higher ground but isn't the case.

Should I be concerned or is this a normal phenomenon?
