The maker says you can cover them....

If you are installing them in a bathroom you'll need sealed enclosures over them, not just insulation, and you'll need to apply for Building Regulations approval before you start.

Does this mean any downlighters are notifyable for Building Regs?

Adding any lighting in a bathroom is notifiable.

Installing downlights anywhere is notifiable if they are ELV ones which are not a pre-assembled lighting set bearing the CE marking referred to in regulation 9 of the Electrical Equipment (Safety) Regulations 1994(a).
