DPC height from foundations

Hi,

I'm looking to build a small patio outside a new extension. But the DPC is only one brick above the foundation - firstly is this correct and what is the best way to install a patio.

I understand that the ground level should ideally be two bricks below the DPC and I can't dig through the foundations ?

Usually dpc is directly below door cill.

And foundation is generally much lower -is that definitely foundation?
 
Ok checked under the cill and there is a damp course on that layer. Doh !

That is def' foundation though but with 3 bricks that's ok right ?
