You do not understand that "hot" is relative Not hot enough allows bacteria to flourish and to hot scalds people.

THUS what may be to hot in one application is actually TO COLD in another thus if you had bothered to read and learn various codes BESIDES your Mickey mouse plumbing code you would see that the health codes also would come into play.

Again for the pea brains who do not quite understand hot is a judgement call based on criteria available and nothing is carved in stone in court.

For example Ted Kennedy is a known drunk driver who left a young lady to drown as he went home after his car crashed over a bridge and he never spent a day in jail BUT if anyone but a senator or son of a judge would be found guilty of man slaughter jail time would be awarded,

So it goes with "hot water" cases.. Thus I can fully understand why the unknowing would think lawyers make to much money because they work for slave wages and think everyone is as non skilled as they are.

If lawyers can demand higher wages then it stands to reason the expert witnesses who make their cases should also be very well compensated for knowing the various codes out there.

Law is a game and the ones who know several game books win and command higher compensation then imbeciles who only think of one code or rule book are the same blokes who will cry "he makes to much money"

AGA, CS, FS,NYC PLBG code, NYS plbg code, National plumbing code, board of health, ADA (Americans with disability act) Nursing homes, Kindergarten ALL have a section of the code(s)

One code does not fit all thus one if they study their trades and professions can "cherry pick" the exact section of the various codes that may apply to the case at hand.

The codes are tools to use and give a min guide line

The real problem is lawyers now advertise and thus everyone is a victim and because the rewards are huge for being a victim of society such as being burned of becoming sick at a restaurant or falling off a ladder the suits are outrageous thus everyone wants a piece of the pie.

The trouble with "law" is like plumbing codes and gas codes and building codes they are very ambiguous in terminology subject to interpretation.

When a Master gas fitter goes to court for example and starts to razzle and dazzle the laymen sitting in the jury box and if they really spin a great tale and quote sections that the expert feels are important to the case such as flue pipe sizing and BTU input and developed length of piping the jury becomes overwhelmed and all they remember is some how spillage caused someone to get deathly sick.

The same for hot water cases, in a restaurant someone gets sick and the victim calls a lawyer and the lawyer looks to find an expert that can make their case

Here a Master plumber is called in and he /she takes the water temperature and finds it is to low to kill bacteria and hence the plumbing experts helps win the case.

A few days later a patron is using a bath room sink in the same restaurant and gets their hand scalded calls another lawyer and an expert witness ( plumber ) is called in and states the water is to hot.

Same building different applications and because the same water source was used the owners is faced with a lose, lose situation

Same as a lawyer asking a defendant "do you still beat your wife" only answer is yes or no BUT the jury now thinks the bloke is a wife beater.

The idea in court is to win the jury over and place an idea in their head even if the other side objects the thought is already placed in the jury's mind

Law is a psychological game to get the jury to like you and they will find in your favor and very little to do with actual facts.

Here are true cases

A drunk was waking across a 6 lane highway at night and was struck and killed by a bus

The mans family sued (even though he illegally entered this country) and he was 3 times over the level of legally drunk

An expert witness stated that there was no guard rails and the "gentleman" although drunk was not afforded protection from on coming traffic and the jury found the bus driver guilty and awarded his family over 3 million dollars

A burglar fell through a sky light that was painted black and he broke both legs and an arm he sued as the sky light was not visible at night and the jury agreed and he won over 5 million dollars.

An old lady in McDonalds spilled coffee on her lap sitting in her car and sued and won as the coffee was to hot ( remember she was sitting in her car) and the coffee spilled in her lap and she won the law suit

No common sense WIN or lose that is how law works today

Yes many times in court I go against engineers that I worked with on some cases and against on others.

Nothing personal its an "opinion" even lawyers after a while pro and con go out to lunch during their break and talk about other cases pending .

Its a business like any other.

Two years ago I testified in court and the client won a large cash award from an insurance company's client.

This year the same insurance company's lawyer hired me to defend an action against them.


It is very common to have doctors testify one for the victim and another for the hospital or practice.

Many retired engineers and doctors and a few plumbers are on a list of expert witnesses as well as other trade professionals.
 
Then you're no "expert", really, are you? More a case of just being some two-bit knob-jockey, who bends with the breeze, depending on who's paying your bill, rather than giving an honest opinion, regardless of whether it helps your side's case or not.

At some point, you will get found out and get a wasted costs order against you. Might make you rethink your assessment of yourself as the reincarnation of George Carmen QC.
