At long last, the MoD shows a bit of common sense and tells the European Court of Human Rights to "Shove it right . . . ."

Defence minister Bob Ainsworth said the right action was taken but admitted the men could now face the death penalty.

Iraq's government had made assurances that the men would be treated humanely.
So, no problem, is there?

Makes you wonder how they think under the European court of human rights they could seek protection seeing as that they are in Iraq anyway.
 
Surely they only face the death penalty if guilty, in which case .... so what?
 
If a New Labour minister has shown some common sense, it must have been a complete accident.

When I read the title quickly I thought you meant mod as in moderator.

Obviously the cava is already kicking in, as this could never be true.
 
The injunction came from Strasbourg, apparently. Strasbourg, a town in a country that follows the Napoleonic code, a presumption of guilt. How can a court of human rights exist under such a tenant?

Any, it's outside the jurisdiction of THAT particular court, both geographically and as a matter of nationality. Specifically, despite the horror stories of political correctness gone mad, European civil law has no bearing on our military proceedings or our criminal proceedings.
 
Was the coroner's decision of unlawful killing made in a british court? If so what power does that decision hold in Iraq? What right has a british court to decide what is right or wrongly done in another country?
Were the soldiers on active service, in that case its a hazard of the job if you dont wish to be shot at dont join the army!
