Planning Permission / Owner or Builder

Hello

If a builder is asked to do a job which he suspects planning permission may be needed, could he be held responsible if work is carried out and then planning say it has to come down/be removed because permission has not been granted?

Is the responsibility for lack of planning permission down to the owner of the property or the builder.

Though you could have separate redress against someone who advised you that planning was not needed.
 
It is not the builders responsibility to obtain planning unless of course he was contracted to do so - which they almost never are.

When a builder comes to a project the owner of the property (or more clearly - the builders client) is responsible for ensuring that the relevant permissions are in order. The builder doesn't even have a responsibility to check that permissions are in place - he just needs to follow the extent of his contract.

The builder has an implied duty to know about any planning permission which might be required, and to advise his client accordingly.

But any planning breach is the responsibility of the land or building owner or tenant/leaseholder
