If planning permission is refused ,because of a neighbours objection ,can you then down size the build and build under permitted development ?.Or would you have to go back through planning .
Simple three metre long ,times width of house ,detached bungalow .

The simple answer is... yes.

Some people when building something under PD would like to obtain a Certificate of Lawfulness, which is the formal and legal documentation required to confirm something is PD but there are many people don’t bother with the CoL process.

Have you had the application already refused? Or because a neighbour has objected you think Planning will be refused? If it’s the latter, just because a neighbour has objected doesn’t mean Planning will be refused. The Planning Officer will review any objection and decide whether it’s a valid reason of concern. If Planning is refused, you would normally get the option to re-submit a revised application free of charge. That may be your first option and then result to PD if formal Planning is refused.

What size is the current scheme... or is it 3m deep across the full width?
 
On a couple of points of dull pedantry, while a Certificate of Lawful Development may put an issue beyond doubt, I don't think it's quite correct to use the term 'required' here (except in the sense of appeasing nitwit conveyancing solicitors), and you always get 'one-free-go' (regardless of whether an application is withdrawn, refused, or approved) provided that the resubmission is substantially similar to the original.

Not if the applicant has used up a free go on the same site in the past.
