Basically we had a 2man band in 2years ago now to fibreglass our flat roof and dormer roof, they gave me a 15 year garuantee although after repeatedly pestering them never received a garuantee.

All was ok until the following summer when the whole roof started blistering up like the elephant man.

Called them and the answer machine says they are no longer trading. Am i stuffed?

You never got a guarantee and they have ceased trading.

Yes you are stuffed. Were you hoping for a magic fairy-god-mother out of the hat* ?

( *please excuse mixed mataphors ) ?

The only sort of warranty that would (may) have helped you would be a 3rd party guarantee which kicks in if the company goes bust. If, however, you read the small print it probably requires the company to be formally wound up & not to have just ceased trading (& as in my case) so somewhere along the line, a creditor of the company has to instigate court proceedings for a winding up order for the terms of the warranty to kick in; basically they are still pretty worthless. You could pursue the company through the civil court but you’re almost certainly on a hiding to nothing with that one.

Luckily my own problem was relatively small & simply to fix myself, albeit at my expense!

That's not a metaphor.

And no i wasn't you bellend (no that's not one either)

I was wondering if and when people are liable ie using a limited company (where i believe you can be protected somewhat) or sole trader.

Looks like all the expense and trouble is down to you then . What a shame !

It is a mixed metaphor as "rabbits " are pulled out of hats but in this case "fairy-godmother" was substituted.

I'd check them out a bit further. It's a common trick of cowboys to just change their telephone number every year or two but carry on working. They know their work is sub-standard and problems will eventually arise so this is just a way of making a break from any complaints. They don't ever get repeat work so they don't lose anything by doing this.
