Thoughts on retaining below neighbours fence

I'm digging out for a concrete path down the side of my house. Ground was up to the DPC in places so it's getting dropped 150mm +100mm slab and 100mm sub base.

Issue I have is my neighbour's house is about 1m higher than mine. Her fence (yes it is hers according to the deed plans) already has a concrete gravel board 300mm high and get soil almost to the top, but it only comes down as fast as my DPC. So if I'm dropping the path I need to drop the retaining too. Board can't slide down any further, I'm not convinced the posts are even in the ground that far. I haven't discussed it with her yet.

I know the proper thing is to replace her posts lower down with another row of boards or build some kind of retaining wall + drainage but that's scope creep. Does anyone have any other ideas about how to tackle this?

Compounding factor is her sewer line runs right next to the fence so I'd bet nervous about digging deeper posts in too for fear or smashing the pipe.
