I know apportioning blame is all part of politics. But I think Jenrick is being very disingenuous here. The "Lammy" report wasn't something David Lammy decided to draw up on a whim. It was an official government report, commissioned under two Tory Prime Ministers. The new guidelines, which the Tories are now complaining about, were published in autumn 2023 and put out for consultation. Nobody in the Tory government raised any concerns during the consultation process. From which I conclude that this was all a Tory idea and they were completely happy with the new guidelines.

I believe this is the sort of reason on why Labour and Conservatives have earned the nickname 'the uni-party'.
As per normal the sad miss the point of the pre sentance report changes... and the ensuing bollikins that that erupted. A pre sentance report is there to ensure that the correct sentence is awarded, as most magistrates courts surprisingly have legally untrained magistrates in place. All this does is tell the courts to get a pre sentance report not what sentence should be issued. This all stems from the simple fact that overturning a sentence is virtually impossible, see the post office for they reason and the need to get a sentence right as the process of a appeal has become virtually impossible.
For example a disabled man was sentenced at Rotherham to 200 hours of community service for electricity extraction without the magistrate bothering to find out his circumstances. He has mnd and is trapped in a wheelchair... how will he pick up litter or paint a scout hut ? Pointless sentence.
Most of this relates to single point justice where magistrates just find people guilty on the basis of documented evidence rather than a court appearance. Please do not say people can elect to go to court, since legal aid was abolished try finding a solicter to even write to a court.
This is an attempt by the sentencing council to fix that problem, the total lack of any legal representation.

I never thought positive action would find its way in to criminal justice.

Tories launch legal action to block Labour 'two-tier' justice measures
Shadow Justice Secretary Robert Jenrick is poised to mount a judicial review against the Sentencing Council after it announced astonishing moves to give minorities special treatment in the courts.
'Mr Jenrick has instructed a leading barrister to submit a ‘pre-action protocol’ letter to the Council warning them the measures will be challenged in the High Court, it is understood.
The Tories will also urge the Government to halt the measures by laying an amendment in the Crime and Policing Bill, currently before Parliament, if the Sentencing Council refuses to back down.
Mr Jenrick said: ‘I will be challenging this sentencing guidance in the courts on the grounds it enshrines anti-white and anti-Christian bias into our criminal justice system.'

It isn't crystal clear here whether BAME is being spoken about but I wouldn't rule it out. It is crystal clear 'young adult and female offenders' are being spoken about.
