Stamp duty isn't a tax return form.
 
You either pay the tax due, legally avoid it or attempt to evade paying it.

You can’t “attempt to evade paying it” if you pay the amount you’ve been advised.

2) client“ok, I’ve paid £40,000 to HMRC”

No, the conveyancer normally works out what you are due, charges you, then pays HMRC.

Nothing specifically gets signed for stamp duty.
