PC Andrew Harper's

The Sentencing Act 2026 is Labour's work. They haven't done the proper analysis to work out if the proposals lead to the wrong people being let out or unfair punishment for the financially better off. It’s a bit of a mess, like most of the legislation they have come up with.
Higher fines for the rich was Ken Clark’s idea iiirc. All governments need to balance retribution public protection and prison conditions. Even the fantasy football league coalition of Rupe and Nige.

I would’ve found the driver guilty of murder but difficult to pin that on the passengers
Do you mean the other thief who was laughing and joke after sentencing.

Since you seem interested in learning about this stuff. Does joint enterprise help?

What this government hasn’t done is test their policy by analysing the impact. It’s the sort of thing AIs are good at.

Who is eligible, review the sentencing remarks. Look for particular comments about victim impact, remorse etc. flag those that need to be reviewed.

Yea, you mentioned that before. Not sure that works , there’s no duty on the passengers to drive carefully.

If I and you go to steel a car and somebody tries to stop us. If I am driving and I look like I am going to risk killing him and you say…

A) get him
B) nothing
C) stop

Does that change the situation?

if they shared a common criminal intent to commit the robbery and foresaw, or intended, that grievous bodily harm or lethal force might be used.

The outrage about PC Harper was understandable, and I share it, but there are several hundred other manslaughter prisoners that the press aren’t worried about because the story isn’t triggering enough. I’m all for more nuanced sentencing but press interest and AI is a recipe for unfairness.

I think the problem was the jury believed that they weren’t aware he was being dragged. And they weren’t going to incriminate each other either either a b or c. The driver took the rap to save the others. It didn’t work

Have you read the sentencing remarks?

These crims should not be out on the streets early.
