    is that not just a knot? looking at the photos, absolutely nothing to worry about, as someone has said, it's a jack rafter, it's short & strong. get rid of the nest and try to seal up where they're getting in. Mind not to block up all the ventilation

    buy 4" butt hinges (uncranked) and 1 1/4" x 8 screws should be enough, don't use No. 10 screws

    trying to see where the 4x1" is, are you seeing the top of the newel post? as thats just a chamfer to the top of the newel. i'd lift the flooring to see if there's a way it can be fixed more square before cutting it
