If the flats are separate units then its up to the electric board how they go about suppling each flat.
More than likely one flat to each phase, then the other flat onto one of the phases, unless there is an unbalanced load on the transformer that they want to correct.

Depends how big it is.
You could feed the flats off a 1Ø supply if it were big enough, just as you could not use a 3Ø if it was not of sufficient capacity.
