45 degree rule question

Hi

Currently discussing pre-planning with council for widening a flat on the first floor, and they are citing the 45 degree rule as reason why it cant be done. My problem with this is that the flat is the last but one (ie next to the corner) of the terrace and the window is the last but one of the perpendicular terrace. This means that no matter what the scenario there will always be a 45 degree relationship. The whole flat is already breaking that line, so whether or not it goes back another metre or so makes no difference to the light.

Do the council need to demonstrate that the change is actually a change, rather than just draw the line and say it breaks it? In my head, since it is already broken then any alteration doesnt change this. In fact it is almost like a facing property in this respect. Also, any 45 degree line will eventually hit another building if it goes far enough!!

It's not for the council to prove, it's for you to prove otherwise, so why don't you demonstrate that your proposals don't make the situation any worse, if that's what you're saying. And your diagram is useless and your description is not much better. Even a photo or two would help.
