Air Admittance Valve

My son as just had a extention built.In the new bathroom the plumber has fitted a air admittance valve next to the close couple cistern and it is lower than the sink flood level . I thought air admittance valves had to be fitted at the hight of the sink flood level. Is this correct?
 
Correct; the valve should be fitted above the flood level of the highest fitting, in your case presumably the wash-basin.
