As above really, current owners of a house arent sure if they ever had one, but i would like to see if one was ever served to a property? Do you know if this is possible?
The problem is,were soon to be moving into a new house, we recently saw next door have done some extensive ground works and they have dug down say 4ft deeper than our driveway or maybe more at the side of our drive and potentially the house (potentially only as ive not seen right round the back yet). Advised by our solicitor to see the vendors to ask, theyre old and dont know. Spoke with the builder briefly today who said a retaining wall is going up but i think its within 3 meters of our house which makes me worried that kf there is no party wall act im in for a potential issue..?
The PW Act will not apply to groundworks or retaining walls. It also becomes obsolete as soon as any works to which the Act applies are complete.
Any damage is actionable under common law in any case.

If you experience damage to your property due to the actions or negligence of another, then you can claim from them for your losses. This is even if the PW Act applies and was followed.
