Changed my car insurance and noticed in the conditions that they don't pay if the driver is over the limit for alcohol or drugs. Can they do that, legally?
If their driver is at fault in an accident, due care etc, that's just when they do pay out. Is drink/drugs different?

Yeah. The other innocent person is fine but if you drink and crashed your insurance is void. Even if not your fault. Although it is your fault for driving with no insurance as you are drunk.
I always thought that was how things were.
No insurance company will cover you to drive while drunk

They will always pay out to an injured innocent third party whenever the circs. They won’t pay out for damage etc to the driver or his car if they are found to be driving under the influence or recklessly etc.

I know a drunk driver that crashed into a house. The insurance paid for the house repair but not the car.
I knew a guy that sat in his car listening to the cricket.
If he was drinking a fair bit with the keys in the ignition at the time ( he wasn't) and someone drove into him I wonder how the insurance company would view that?
It's an interesting subject when you break it down. One for the black belt lawyer I think rather than me
