Conservatory being built - whose fence is it?

The wall would be subject to the party wall act but belong to you. If your neighbour later decided he wanted to make use of it then he would need to pay for half the cost (calculated in the value at the time of his - not your - work).

Ok thanks for clarifying. Been reading the party wall explanatory booklet and I thought it was saying if you build a wall, in effect, up to the boundary then the neighbour could in effect then treat it as a party wall.

But thanks for clarification.
 
The Party Wall Act does not state what is or what is not a paty wall; it merely confers rights/obligations over an existing party wall.
