Dimmer switch remains live to touch

I have fitted a dimmer switch and all works fine, for curiosity though I touched the touch panel (that dims the switch) with my power tester screwdriver and it shows up as live, is this correct?

It doesnt give me any shocks or anything, is this fitted incorrectly or is this right? (The front of the switch is metal and yes I have earthed the switch).

The tester is just picking up a signal if you were to use a moving coil multimeter to test the plate to earth you would hopefully see nothing there but of course there is a remote chance it is faulty so i'd check with a meter to make sure.
 
id also check that there is actually a connection from the switch box earth wire to earth.
