Dodgy Chimney

I live in an end terraced house and have a chimney on the gable end which is leaning in towards the roof slightly. As i don't have lots of cash to pay out for scaffolding and even dodgier builders would it be alright to lower the height of the stack or do building regs require it to be certain height, there is a cowel on top of the chimney as i have a living flame fire, any suggestions.

Youll need planning approval to alter it.. and they can be funny about chimney alterations unless others in the street have done same.
 
Will look at neighbours chimneys first and get some info from the council building regs department.
