Fireplace chimney opening. Sweep has said its too big?

Have recently bought a victorian terraced, with a lovely cast iron fireplace in the lounge. Have has it swept, but the sweep has said it could be dangerous as the opening/ratio is too big. (as per building regs 2002)

Can understand this, as its been a working fireplace since 1903. The chimney is now clear, do you think it would be ok for me to burn logs in it?

Surley not every victorian chimney has had remedial works carried out to Building Regs standard?
