garden decking raised more than 300mm

was going to have my garden decking delivered on 01/06/2011, only to be told that because it's off the ground at the opposite end from the house (planning officer),approx 1mtr, that we will need planning permision,the end at the house will be on the same level as the existing footway that borders the house, the ground is naturally on a slope, as the estate is built on a hill,our next door but one neighbour has a coservatory, which is higher than our planned decking,they can see right into our garden,this is not a problem to US,all the gardens have a three foot dividing fence anyway,the deck would not be tight upto the boundary anyway,any ideas??thanks in anticipation
