Help - Patio higher that garage damp course

Hi,

My neighbour has built a patio up against my garage wall that is about half a metre higher than the damp course in my garage. As the patio is built out of compacted down rubble covered in loose pebbles he claims that it won't cause damp problems in my garage wall. Is this correct or should there be a gap between the patio and my garage?
