Insulation above cavity tray

Hi All, in a new build property and recently had a thermal survey due to cold rooms. The survey showed heat loss above each window where the cavity trays are. From the loft space there is a soldier course of bricks visible above the tray.

My question is should there be a fire sock/cavity closers here? Could they be retrofitted from the loft space to reduce heat loss in this area?

The insulation company are due to return to carry out remedial s elsewhere but said they do not touch this. - who’s responsibility would it be?

Any advice on installing or building regs would be appreciated.
