Is it murder or man slaughter

My first thought is that there doesn't seem much of a half way house. He was either defending himself or it was murder. You can't stab someone without realising it will cause really serious harm.
 
The BBC omits significant parts (as usual) from this story. Henry Nowak was filming on his phone and engaged in some banter with the Sikh man. The Sikh then stabbed Novak, the incident being filmed all the time on Novak's phone. The Sikh took Novak's phone. The police arrived and the Sikh informed them that Novak had racially abused him. The police then handcuffed Nowak as he was bleeding to death - rather than adminster first aid. This was filmed on police bodycam. The Sikh's mother is on trial for concealing the knife after the stabbing.
 
It’s not about religion for me at all, or race. I just don’t think it should be man slaughter. He had a knife and took someone’s life with it.

Carrying a knife is a serious crime, and using it to stab someone makes it murder imho.
 
If you are going to carry a knife and actually use it, by the very act of plunging it into someone then you can only assume that they meant to kill or murder them.
 
I think this might prove to be complex. But the problem for me is this.

“The prosecution says the kirpan – a religious knife – caused five stab wounds to Nowak, including two to the back of his legs and a fatal wound to the chest”

I think the kirpan falls under the offensive weapons exemption but I’m not sure if this only applies to small ceremonial ones.

The judge realised the defence put forward could involve manslaughter and added it as an alternative charge for the jury to consider. They can presumably still convict for murder or acquit altogether.
 
What did the defence argue, I wonder. That he stabbed someone five times with an eight inch knife but didn't realise that would cause really serious harm. Or that he was so panicked he lost control. Are there more details.

Mbk has told the forum on many occasions that you have to Intend it. Id be willing to bet there are many cases of multiple stabbings that don’t get past gbh.
