Patio near DPC

HI, i have a patio which i want to dig up and replace, i also want to raise the patio slightly so that is fits into the garden - i have read online that the patio should be 15cm below DPC - the picture is my current patio (excuse the weeds) would it be better to keep the level as it is now and create a step into the house or could i possibly take the patio height up to the first brick - the patio will slope away from the house - thanks in advance for any help

Not sure what the building regs say but the garden & building shows on TV seem to put them level or above DPC, so I presume there is a way round it.
