It is indeed good news,but would it not be better to put this case and the other recent one in front of a jury to hear the evidence.Surely that way if an acquittal is made then there is a legal precedence as to what is "reasonable" in using force in protecting your home,rather than relying on the CPC.
 
If the powers that be decide he used reasonable force, then there's no need for a trial to set any sort of legal precedent.
The legal precedent has already been set by the decision not to prosecute him.
Have to agree with Mattie though. Common sense has prevailed.
 
Excellent news. As that's the 3rd case recently where the home/shop owner has not been charged over the death of a burglar, that sends a very clear message to the scumbags not only in Greater Manchester but all over the country.

As long as people remember not to stab them in the back, they'll be fine :cool:

In a word, No!!
 
But remember that each case is judged on its specific circumstances.

In this case, the homeowner was marched upstairs by the burglar who had the knife, and when the homeowner's family came back there was a genuine fear for their safety and a struggle

Its not the same as just a struggle, or initiating a struggle and not the same as going into the kitchen to get a knife to "defend oneself"

The law is still in favour of the burglar, nothing has changed
 
Great, no way this man should've been convicted.

Sorry but if you break into someone's home, whether you physically threaten the owners or not, you should know you are putting your life in danger.

Burglar's get away with far too much. If the law won't stop them, let homeowners do it.
 
No way should he have had to go to court, he was defending himself, his property and his family.

Unfortunately though, this poor man has to live with the fact he killed a man, albeit a low life - I do hope it does not torment him for too long.
