Neighbour problem

Im not sure if i am posting this in the right area but basically i live in a mid terrace house and the next door neighbour have started to build a new extension into their garden. They dug up the floor next to our house wall and left it for few weeks first (they couldnt find builder apparently) so it used to rain and get into the foundation of our house. Now they have started off the work they have left our wall as it is bare and not cemented it or anything just started building their own seperate wall. They are going to leave our wall as it is. I mean shouldnt they seal it or put concrete around the slabs to prevent water going into our foundation? See picture. Green letter my is my wall.
The other thing is that we have got like a greenhouse area one wall is concrete and we bought this land years ago about 30+ and now the neighbours are building a wall next to it a double wall basically they are digging up and instead of ordering a skip and throwing soil between the new wall they are creating and our old wall marked in green. We are in a couple of years going to rebuild that wall and i did inform them about this and he just replied when you rebuild it i will come round and pick up the soil.
Anyone know what can be done about this they did not inform us about any work at all.

Anyone know what can be done about this they did not inform us about any work at all.

It would appear that they have not notified the local council's Planning Department. If they had notified then the Planning department should have given you the information abput the application.

Suggest you ask the Planning Department if they are aware of the work.
 
Are they tipping earth either, between your wall and their new build, or? down their new cavity?

In one of the images posted I cannot see ant concrete foundations?

Pull in the Sheriff, in the form of planning and the B/C to see what the Cowboys are trying on here.

I can't see any problems. That's a standard thing and will not negatively affect your wall.

It would have been nice of them to have a chat with you regarding what's going one but then again you've not had a chat with them asking what's going on.

Not sure why they are packing soil into the wall. Tell them not to as it will make your wall damp.

When you need to rebuild that wall, you can just get rid of it and use their wall.

Not really unless they give permission, i guess that's why they left an inch gap, to prevent it from becoming a party wall. That can also save them having to serve notice under the party wall act if they manage to make the foundations shallow enough.
If it is a party wall then you can under the party wall act, but you'd still have to pay them half the cost of the wall.
 
This is a tricky situation unfortunately.

It seems a previous owner your side may have built right on the boundary with the foundations going over next door, hence the tiny gap. So maybe they have joined your foundations up with theirs, which they are allowed to do.

As regards the earth in the corner, yes that is not a good situation for you but in order to make a claim against them you would have to prove 1) you have suffered damage and 2) they caused it. This is not much help as it's a hard and potentially expensive thing to prove.

I think your only practical option is to offer to pay for a builder to put something inert down there to improve things.
 
Re-reading the OP :oops:, soil placed between neighbours walls above ground level is not acceptable. It would be a trespass, and if there is a room on the other side of the wall, not just garden or a shed, then a potential Statutory Nuisance.

Since Grenfell that's the only type of insulation allowed in extensions?

Suggest you consider, given the above? making a call to the Local Authority Planning and Building Control and see what they have to say about all of this.

Is it still possible to see the packed earth in the new cavity and between your property and the new wall? If so get building Control round fast.

Over time the earth in the cavity and between the new wall and your wall will allow ground water to rise and eventually your wall will become saturated, no matter where your DPM is

I have sent an email to my local council building regs but they are building the whole thing fast so if building regs do come it would be late.
If we in future do plan to make a new greenhouse/ store room then when we break our own wall down all their soil it going to end up in our garden.

Take regular photographs for evidence of the activity.

If the evidence is clear and decisive an enforcement order could be issued for the removal of the offending structure.
