You're suggesting that there are some private schools that accommodate students with special needs, alongside students without special needs?
The special needs of such students can't be that important.
But it's the choice of the schools to accommodate what kind of students they can cater for.
If their VAT status depends on such choices, and they must pass the increase onto the parents, the parents will seek alternative education suppliers, where VAT is not charged, and the alternative school can provide equal or better support for their special needs.

The criteria is clearly defined within the Education Act.

The previous two paragraphs to those presented by you, more or less confirms what I've just said:

Your second statement is utter rubbish. Who are you to say that a child with some neurodivergence wouldn’t fail in a state school but thrive in a private school? I would have thought you of all people would understand the struggles of fitting in when you are wired differently.

Please do enlighten us where these VAT free schools that offer the same have been hiding.

An Education, Health, and Care Plan (EHCP) is a document which details the education, health and social care needs of a child or young person. It details what is needed in their early years setting or school, beyond that which the school or setting can provide.
May be part of the reason B.'ham has gone bust, their header copied. The EHCP is the authorization for special needs. The system should provide it. If parents just say well this private school would be better that is their problem.
The same sort of thing applies to a parent who succeeds in persuading a school that a child is in need of special needs. A state school needs to supply the tuition that is indicated. As I pointed out I do know some one who went down that route. Entirely different area and a lower level. And not autism. You picked the trickiest one,

Autism. A spectrum disorder. Read about level 1. That can allow a pretty normal life but there can be complications including what is called burn out. I do know some one who has that problem now and again. Part relates to them knowing they do have a degree of autism. Some details in the link.

There is a link to treatment in that. It starts by pointing out there is no cure.

This one discusses 3 levels but it's not that simple. Higher levels can mean being kept in care for life. State special schooling ends at 18 if extended. These days they only handle serious cases.

Take Finland. Population 5.5M, end of comparison.

Do you think that a bigger country couldn't be able to organise a similar system regardless of population size?

It's all about the elite wishing to remain the elite in the UK, and that pervades throughout all of our society!

Quite a large group of people sending their kids to private school are doing so, because the state school cannot cope with their educational needs.

And why is that?

Oh that's right, underfunding and undervaluing the state system that serves the vast majority!

And btw the private schools started raising their fees before the plans were finalised...

With the most elite (Eton, Harrow for example) leading the way with 20% increases when the plans were finally revealed...

But hey if it was c£53k before, whats an extra £10k 'investment' to keep the same class system in the UK ticking over

However if the math works out and 6,500 new teachers are recruited for the state sector, then it's a price worth paying by the elite

Trouble is most of that will go to academies (effectively businesses under business law) who are also allowed to claim VAT free status in certain areas due to 'charitable status'...

And being supposedly 'non-profit making', they can make the most of that...

Whereas LEA schools have to be registered to pay VAT...

And are saddled with heinous PFI contracts...

Not exactly a level playing field!

Several posters have stated that the schools in their areas are advertising for pupils. You can't have it both ways.
