Birthright citizenship is in the constitution. If the child was born there it's a citizen.

The trump administration don't want to involve the courts in this.

They know they'd lose most of these deportations if they came to court and so the plan is to move too fast for the courts to block it.

I can just see a scenario where a lower court rules that the girl must be returned, and Trump's team turns round and says that they won't allow it because they don't believe she is a citizen.

Lies again the president of el salvador would have to re deport him to the US for the US to refuse but he isnt making any such request as he realises he was an illegal and member off a notorious gang .
Did you miss the interview on the telle when the president of el salvador said he wouldnt ask for the US to take him back .
