Gas flue modification carried out without permission!

Well, that is the point I have been trying to make to our solicitors. It is serious, even if it seldom results in a conviction under law. Do you know the regulations I need to quote to get this point across?

Thank you for confirming this point - do you know where I can find the appropriate regulations to support my argument that their actions were illegal?

How would you prove who actually modified the flue ?

They provided a bill and a demand for payment for the "service" provided.

Oh i see, just out of curiosity how much did they charge :roll:

DeeDee, what are you hoping to achieve from this quest, apart from falling out with the neighbour?

DeeDee, by now you have realised that quite a few rules, regulations and laws have been bent somewhat by both parties. No one has been injured and its highly unlikely you are going to be able to prove that persons where placed in an immediate danger. All possible dangers have been removed and/or rectified so its unlikely that HSE/Corgi will be interested, your solicitor's not interested, I expect they regard it as an unprovable, worthless crusade and are therefore acting with your best interests in mind.

(9) Where a person performs work on a gas appliance he shall immediately thereafter examine
(a) the effectiveness of any flue;
(b) the supply of combustion air;
(c) its operating pressure or heat input or, where necessary, both;
(d) its operation so as to ensure its safe functioning, and forthwith take all reasonable practicable steps to notify any defect to the responsible person and, where different, the owner of the premises in which the appliance is situated or, where neither is reasonably practicable, in the case of an appliance supplied with liquefied petroleum gas, the supplier of gas to the appliance, or, in any other case, the transporter.

There's more when I find it

Dee, I dont see what you think you are going to gain.

Your parents never had any right to discharge their flue over the neighbours land.

The neighbour has every right to do anything they like on their land like building a shed.

Your parents have no argument.

Why dont you accept that this is history and there is no point in wasting any more time or money on it.

As a matter of amusement, how much have you paid solicitors for all this?

Probably enough to fit a few new boilers?

Tony
