Boundary Dispute - Advice Sought

We have just discovered that the our next door neighbour's extension has it's return wall attached to our property not his own -viz on our side of the boundary line! This would prevent us extending our kitchen as he has done. His builder re-aligned the fence which tended to mask the effect to which he had intruded onto our side of the line.

The law appears to be on our side but before we dig out the pickaxe and sledgehammer [to improve the ventilation of his kitchen] does anyone have any experience of a similar situation?

He is quite a nice person but has a somewhat cavalier attitude to rules and regulations. For example he has carried out many changes and none have had approval regarding planning regulations even though at least 3 of them need it.

you could always drop a hint to your local planning office. :evil:

have you approached him. What does he say on the matter?
 
Pop down to your local planning department and ask to see their drawing for a free advice, they will be very helpful.
 
The above two replies are a good starting point, but after that you will have to get legal advice. We're not lawyers here and you could be very disappointed if you rely on advice on this forum.
