can I cut this bit off stairs

Hi, Ive got open tread stairs built in 1986, Theres a bit that hangs just at head height and seems a hazard to drunk people.

Im wondering if theres any structural reason that it cant be cut higher so its more in line with the rail the stairs are attached to ?

There should be a mortise and tenon joint just above that piece where the stringer meets the newel post so cutting the bottom of the newel away might weaken the joint. In other words I, personally, would leave well alone - and maybe consider drinking less?

Haha I thought that might be the case unfortunately
the old chap who used to live there stapled a bit of carpet to it so it was softer on his head !
