Fence height without needing planning

It's 2 metres, but is this the height of the highest panel or post? I have a neighbour who will be straight to the council if he sees anything over 2m going up :-)
 
Your panels and posts are normally within 10mm- 20mm. The council won't bother about 10mm or 20mm over.
