The Highway Code clearly states the hard shoulder must not be used for overtaking or avoiding congestion. Using the hard shoulder to avoid traffic is not only selfish - it's illegal

It was the headline M5 drivers fined. I believe it's a flashy BMW.
 
I wish more would get fined for passing the red X on motorway lanes when, they are also needing to be closed. Same as those who’d drive to the front in the wrong lane and then suddenly “realise” they need to move over.
 
I can understand some of the excuses. Like
I thought they had opened the hard shoulder up to clear traffic.
I suppose one person dose it as they can see the exit slip road up ahead and the others follow not realising.
Maybe they mistakenly thought it was one of those all lane running things (death lanes i refuse to drive in )

There was a thread on here a few weeks ago about merge-in-turn. Most posters seem to be keen on it, and it ought to be standard practice even when there is no sign saying it.

Driving standards have really fallen in recent years, I work on motorways and no matter how much traffic management cone off for us to keep traffic away from us and deploy speed limit signage, people often ignore both. The only thing that works are when we setup mobile speed cameras. I have often had to skip out of the way of speeding cars and lorry's too for that matter.

I have a suggestion (requires a change in the law) - driving in such a lane makes your insurance invalid, so as well as getting done for ignoring the lane closed sign, drivers are then driving without insurance, which AIUI is an absolute offence, so as well as the penalty for that, people would be faced with the delightful consequences of answering "Yes" to "Have you ever been convicted of driving without insurance?" when they renew
