Hi all thanks for all your response's, sorry about delay in reply.
Came back sunday to find builders banging away to extent the house was shaking and couple of cracks also appeared on internal upstairs back wall.
on monday i took a look up where they were working.
this was last straw found out they had cut into party wall to install a RSJ. MY HOUSE ON THE LEFT
tuesday i Told them to stop work and get the owner round as they had no right to go any where near party wall without my agreement.
whist i was awaiting for owner i contacted the legal team of my home insurance and also a party wall surveyor. they both advised me to write a letter which i did informing him to stop his builders and move his external wall which is illegally touching my property to within his boundary.also to contact a party wall surveyor to work on both are behalf if he disputes the matter and repair any damages with a builder of my appointing. called the council again and advised them i require them urgently to inspect this extension.
gave the letter to owner on tuesday night and informed him under the party wall act he should of informed me of any work near the party wall or building a freestanding upto or astride the boundary.
wednesday he came round and said he would repair any damages caused. i have told him he needs to appoint a party wall surveyor and i am not happy with the situation plus no work to be completed within 3 metres of the party wall.
owner now says he will wait for council inspector to attend but adamant that it will pass.
builders are continuing to work and roof beams have now been fitted and also covering up the party wall section to hide it.
From wednesday to friday i have been chasing council to get me an inspector out, contacting the home insurance and there legal team which i await to find out if they will take the case on. Called the police to see if a could get some one around with regards trespass and criminal damage. but they have advised me it is a civil matter.
Raised a case with planning enforcement team with regards agreed planning permission not as what is being built.
Owner did advise me new plans are being drawn up, so unsure how he will do that.
Council at last called me back and will be round tuesday to take a look.
Did notice he made an error on planning application ( look at following pictures),unsure if this is a good case too.
All in all its been a long week.
