Lack of Drop on Kitchen Waste Pipe

I'm installing a new sink & the 40mm waste pipe for my sink drain is a little bit too high for the trap.

This is the trap:

Can I get away with that? The water would be at worst 1 inch over the top of the trap.

What's the worst that can happen? :)

(I'm guessing this is a non-starter so I've started another thread asking about drilling through walls.)

Try googling Double Sink Trap, buthte outlets are likely to be even lower.
