Legally - certainly. The vessels are unregistered, not type approved and illegally operated as commercial ferries. That is without the immigration offences.
Police would have a right to seize the vessel.
Practically, they would be easier to turn back in the shallows than stop on the beaches. The boat could easily be disables while in waste high water. Dinghies are most vulnerable close to the shore, where the waves have air in them.
I have just read that once they are in the shallows, French law means they can't be stopped. Yvette Cooper is asking France to change the law. It looks like the operation we funded had actually been very successful at stopping the boats on the beach. So, instead the people smugglers are now putting the boat in the water immediately and getting the migrants to wade out.
