New Garage in same front print as old - planning permission?

Hello,

My brother wants to replace his old concrete panel/tin roof garage with a brick one that will sit on the same front print. Will he need planning permission?. He has been there over 10 years and the garage was there when he moved in if this helps?

If it is a 'near as damn it' replacement then this could be argued to be maintenance and would not require a formal application.

But strictly, if new foundations will be required and together with the new walls built, then it is technically "development" under planning law and so an application may be required - especially as the garage is likely to be slightly higher than a prefab type.

Having said that, even if it is rebuilt slightly differently, then it may well be 'permitted development' which would not require a formal application.
